HE WILL WEEP: KIBULI H/M KAMULEGEYA SUES EGESA

Facebook bully Mr. Ronald Leonard Egesa must be having sleepless nights while sweating plasma because of the very exhaustive civil court proceedings that Mr. Mohammed Kamulegeya the Deputy Head teacher Kibuli SS has commenced against him. Kamulegeya, a very assertive young man, has filed a defamation case against Egesa who he says variously defamed him using Facebook. Prosecuted by prominent city law firm M/S Sewankambo & Advocates based at Uganda House, the defamation case against Egesa is filed in the High Court Civil Division as Civil Suit No. 084 of 2018. On being served on Wednesday, Egesa became panicky and has since been ordered by Court never to post any defamatory stuff about Kamulegeya or his employer Kibuli SS. This evidently is going to be a very crippling season for Egesa as paying lawyers is a very expensive venture and requires one to have a lot of money. Gratefully Egesa is also not a poor man if his recent Facebook posts are anything to go by. He has previously used his Facebook page to boost lending as much as Shs40m to Old Kampala SS. But ironically, the self-professed rich man’s emissaries have already been reaching out to Mr. Kamulegeya’s attorneys seeking to be pardoned but the very determined lawyers have maintained that: “our instructions are strictly to prosecute this matter to its logical conclusion.” Court records as accessed by our reporters show that Kamulegeya accuses Egesa of maliciously portraying him as a sexpest unfit to hold the position of head teacher because he sleeps with his students at the school. In another Facebook rant, Egesa fallaciously accused Kamulegeya of benefiting from patronage by fellow Muslims who run the show at the Education Service Commission which deploys and transfers teachers in government schools. Kamulegeya was also accused of compromising officials at the Ministry of Education to always favor him by deploying him to lucrative schools.

Egesa also accused Kamulegeya of turning his Kibuli teacher’s house into a brothel and a torture chamber of sorts from where he slaughters female students. In his Facebook rant, Egesa also faulted Kamulegeya for giving his daughter and girlfriend jobs at the school, a claim Kamulegeya says is malicious and untrue. Kamulegeya’s court pleadings show that Egesa, who is yet to file a defense, committed all this actionable defamation in the months of January and February 2018. Kamulegeya avers that Egesa’s allegations against him were false, libelous, unlawful, malicious and negligent and thereby entitling him to compensation by way of damages being paid to him. He demands for general, exemplary and aggravated damages which, once granted, could see Egesa parting with hundreds of millions in atonement of his transgressions. Whereas they are hopeful that their man will win the case, Egesa’s supporters are as well confident that their man has the money to pay in case he loses. Kamulegeya’s co-plaintiff is the Board of Governors of Kibuli SS which has suffered reputational damage as a result of Egesa’s numerous attacks on its staff and top managers using his Facebook page. In one of his numerous posts, Egesa issued public alerts urging parents with beautiful netballing daughters to quickly take them for HIV test and if found negative, to immediately counsel and take them to another school. While accusing Kibuli SS H/M Ali Mugaga of sexual predatory behavior, Egesa alleged that sex harassment of students by teachers was wide spread at Kibuli SS.

NAKIBINGE’S NAME:
Egesa also accused Kibuli SS teachers of threatening pregnant students into aborting and also accuses the school management committee of acquiescing in this conduct by the teachers who they are supposed to supervise. He further claimed that Prince Kassim Nakibinge, who is the overseer of the school, had commissioned investigations into sex harassment. It will be toll order for him to get witnesses that will sufficiently corroborate all these things for him. He also condemned Mugaga, the head teacher, for being a sexpest that should either be retired in public interest or transferred to a boys’ only school. He also disputed Mugaga’s HIV status implying that many female students could have been infected. To prove this, Egesa will have to incur expenses producing Mugaga’s HIV test results to corroborate his submissions. He also asserted that Kamulegeya is related to EC boss Hajjat Aisha Lubega who is the wife of Hajji Lubega Waggwa the chairman of Education Service Commission.

That he also accused Kamulegeya of inciting students to strike protesting Mugaga’s removal from the office of head teacher and to also protest his investigation by the committee instituted by the Education Ministry PS. The plaint shows that all this greatly injured Mr. Kamulegeya’s reputation and character. The plaintiffs aver that Egesa’s Facebook postings created an impression that Kibuli SS was on the verge of collapse as an academic institution. Kamulegeya’s lawyers intend to make Egesa prove that their client is “the amorous immoral man, a philanderer of loose morals and sexpest engaged in abominable extra-marital affair with his students” that he described or painted in his numerous Facebook messages. Kamulegeya also avers he isn’t the incompetent person promoted through dubious means as Egesa’s facebook messages implied.

NOT SCARED:
Since being served on Wednesday, ill-fated Egesa has bragged to his social fans and supporters saying he isn’t worried because he has his evidence and proof to convince court about the truthfulness of his Facebook submissions and that most importantly he has procured the services of Nicolas Opio who is one of the best lawyers in Uganda. On Friday when the parties appeared before the registrar, Opio asked for more time to file his client’s defense ahead of the Monday court session during which parties will make submissions.
