RESPONSE TO UGANDA LAW SOCIETY

Executive Order RNB No. 13 of 2026

Civic Association Within the Ruling Movement Is Lawful

Why the Uganda Law Society’s Opinion on the Patriotic League of Uganda Misapplies the Constitution, Statute and Comparative Practice

The Uganda Law Society’s Executive Order RNB No. 13 of 2026 correctly recalls that the Defense Forces must remain non-partisan under Article 208(2) of the Constitution.

It does not correctly apply that principle, or the registration rules in the Political Parties and Organisations Act (Cap. 178), to the Patriotic League of Uganda.

Article 20 of the Constitution declares that fundamental rights and freedoms are inherent and not granted by the State.

Article 21 guarantees equality and freedom from discrimination.

Article 29 protects freedom of association, which expressly includes the right to form and join civic organizations.

Article 38 goes further. It guarantees every Ugandan citizen the right to participate in peaceful activities to influence the policies of government through civic organizations.

These provisions establish that organised civic activity aimed at shaping public opinion and government action is a protected constitutional right, not a default form of unlawful political organisation.

Article 3(4) reinforces the duty of every citizen to defend the Constitution, a duty that includes lawful association to advance constitutional governance.

Section 1(1) of Cap. 178 defines a political organisation as any free association whose objects include influencing the political process or sponsoring a political agenda.

Subsection (2) immediately excludes pressure groups and civic organizations from that definition.

A pressure group is a body that actively seeks to influence public opinion and government action. A civic organisation is one registered as such under the laws of Uganda.

PLU’s leadership has consistently described itself as a civic organisation and pressure group operating inside the National Resistance Movement. It has rejected unauthorized attempts to reserve a party name.

Its activities—endorsement registers, regional launches and structured membership—mirror the work of other recognized civic bodies rather than the operations of an unregistered party.

Article 71 of the Constitution sets out principles for political parties and organizations, including a national character and internal democratic governance. Those principles apply only to bodies that operate as political parties or organizations under Article 72(2).

They do not automatically convert every structured civic body into a registrable organisation.

Article 72(2) of the Constitution forbids an organisation from operating “as” a political party or organisation unless it is registered and conforms to constitutional principles.

The word “as” is deliberate. It looks to the character of the activity.

An organisation that deliberately remains within the statutory exclusions in Cap. 178 and channels its preferences through an already registered party is not operating as an unregistered political organisation.

The High Court has already declined to treat these facts as criminal. In dismissing Male Mabirizi’s private complaint, the Court found that support for the political ambitions of a serving officer does not, without more, render an organisation unlawful.

Section 97 of the Uganda Peoples’ Defense Forces Act requires a serving officer who “desires to seek political office” to resign first.

Section 16 of Cap. 178 prohibits members of the Defense Forces from holding office in or canvassing for a political party or organisation.

Both provisions turn on present desire to enter a contest and on the body being a political organisation under the Act.

Prospective endorsement for an election five years away, accompanied by public statements that resignation will occur “when the time comes,” does not yet meet that threshold.

Section 2(2) of the UPDF Act restates the non-partisan command in Article 208(2). Neither provision treats ordinary civic association, short of formal candidacy, as automatic breach.

Military Representation in Parliament

Uganda’s own Constitution expressly accommodates the participation of serving officers in the political process.

Article 78(1)(c) provides that Parliament shall consist of such numbers of representatives of the army, youth, workers, persons with disabilities and other groups as Parliament may determine.

Under this provision and the Parliamentary Elections Act, ten serving UPDF officers are elected by the Defense Forces Council and sit in Parliament while remaining in active service.

This is not an anomaly. It is a deliberate constitutional design that recognizes the army as a special interest group entitled to representation alongside civilians.

If serving officers can lawfully hold seats in the highest legislative body of the land under Article 78, it cannot be that ordinary civic association outside Parliament automatically violates the non-partisan command in Article 208(2) or the restrictions in the UPDF Act and Cap. 178.

The Constitution itself draws a distinction between formal political office-seeking and structured participation by serving officers.

Global Practice

Globally, organised civic groups openly and officially support serving military officers without registering as political parties.

In the United States, the Association of the United States Army (AUSA), founded in 1950, exists expressly to support America’s Army—Active Duty, National Guard, Reserve, and their families. It advocates for serving soldiers, partners with installations, and maintains chapters that connect communities with active service members.

The American Legion and its Auxiliary honour and support those who serve, including active-duty personnel and their families, through local programmes and national advocacy.

The National Military Family Association and Blue Star Families similarly focus on the welfare of serving members and their families while remaining civic organizations.

Retired flag officers routinely issue public endorsements—Admiral William Crowe for Bill Clinton in 1992, and lists of dozens to hundreds of generals for subsequent candidates—while serving officers remain subject to restrictions that crystallize at formal candidacy.

During the Vietnam War, the Concerned Officers Movement organised active-duty officers against the war under free-speech claims.

In the United Kingdom, Veterans for Britain, formed in 2016 by senior officers including Major-General Julian Thompson and Field Marshal Lord Guthrie, operated as a pressure group on defense sovereignty.

Former Chiefs of the General Staff such as General Sir Peter Wall and General Sir Nick Parker have led public campaigns and written with Special Forces associations to every Member of Parliament on legacy legislation.

Regional Practice

Regionally, the same distinction holds.

In Kenya, Kenya Veterans for Peace, formed after the 2007–08 post-election violence under the stewardship of former UN Secretary-General Kofi Annan, engages in electoral peace work while remaining outside the party system.

In Zimbabwe, the Zimbabwe National Liberation War Veterans Association mobilized support that proved decisive in the 2017 transition without itself being a registered party.

In Uganda, the Uganda National Teachers’ Union has repeatedly pressured Parliament on salary policy.

Mandate and Conclusion

The Law Society’s mandate under section 3 of the Uganda Law Society Act is to assist government and the courts and to protect the public in matters touching the law.

An opinion that concludes illegality, calls for disciplinary action against a named officer within fourteen days, and invites prosecution of an organisation’s leadership goes beyond neutral assistance.

It assumes the characterization that Articles 20, 21, 29, 38, 72(2) and 78, the statutory exclusions in Cap. 178, the High Court’s recent ruling, and comparative practice place in doubt.

PLU is entitled to continue operating as a civic organisation and pressure group within the National Resistance Movement.

Its activities remain subject to the ordinary laws on public order and association.

They do not, on the present facts and the plain text of the Constitution, Cap. 178 and the UPDF Act, require registration as a political organisation or compel the immediate resignation of its chairman.

The Law Society’s opinion should be read as one view of a contested characterization, not as a conclusive statement of the law.

Respectfully submitted, Morrison Rwakakamba Patriotic Cadre Number: 10590 Heartland Farm, Ikuniro, Rujumbura 28 October 2026. (For comments on this story, get back to us on 0705579994 [WhatsApp line], 0779411734 & 041 4674611 or email us at mulengeranews@gmail.com).
