NRM DIRECTS DPP TO DROP CRIMINAL CHARGES AGAINST CAA BOSS ACCUSED OF DEFACING MUSEVENI’S POSTERS

Acting on the prompting of the ruling NRM party, the DPP Frances Abodo has discontinued the criminal trial and prosecution of Efrance M Musimenta, the powerful Uganda Civil Aviation Human Resources Director who had been put on trial allegedly for directing the defacement of then presidential candidate YKT Museveni’s campaign posters which had been pasted on the UCAA premises in Entebbe. Defacement of notices and posters is one of the many election-related offences created under Section 78(2) of the Presidential Elections Act. Musimenta has been on trial in the Entebbe Chief Magistrates Court under Criminal Case No. 0568 of 2020.
In their letter dated Tuesday 19th January 2021, the NRM lawyers, based at Plot 10 Kyadondo Road in Nakasero, plead with the Presiding Magistrate and the DPP Jane Frances Abodo to have the trial discontinued on grounds that Musimenta has actually always been an enthusiastic promoter of the ruling NRM interests using her powerful office at UCAA. That all this information regarding her role and being a staunch and generous NRM cadre has been corroborated in a Tuesday 1st December 2020 letter by Tom Kagarura Byarugaba who chairs the Entebbe Airport Movement Group.
In his letter, Kagarura says that there is no way Musimenta would have worked against the interests of candidate Museveni or even the NRM party whose mobilization activities she has always been facilitating and promoting using her personal finance resources. That the NRM lawyers have equally interacted with Musimenta and realized her actions were well intentioned and never aimed at undermining candidate YK Museveni’s reelection. She is described as “one of our dedicated and active supporters” in the Entebbe area. That the charges and trial should be discontinued because the NRM party, which is supposed to have been the complainant, isn’t interested in pursuing any further prosecution of Musimenta.
Being a cadre judicial officer herself, the DPP Jane Frances Abodo on Monday 25th January 2021 promptly wrote to the Entebbe Chief Magistrate communicating her decision to discontinue prosecution against Musimenta as demanded by the NRM party through its lawyers. Abodo’s communication is copied to the Entebbe Area regional CID officer and to the relevant state prosecutor.
