City lawyer Hassan Male Mabirizi has revealed his next plan hours after it emerged that the Office of the Director of Public Prosecutions (ODPP) had decided to take over a case in which he accuses House of Prayer Ministries International (HPMI) Pastor Aloysius Bujjingo and Suzan Makula of bigamy.

Mabirizi says that a decision by the DPP’s office, through the Resident Chief State Attorney of Entebbe, to take over his case against Bujjingo and Makula is “illegal, null, void and senseless.”

On December 22, 2021, Entebbe Chief Magistrates court confirmed three charges of contracting marriage by customary law when already married under the Marriage Act Cap 251 contrary to Section 50 of the Marriage Act, Cap 251; marriage with a person previously married contrary to Section 42 of the Marriage Act, Cap 251; and bigamy contrary Section 153 of the Penal Code Act, Cap 120, against Bujjingo and Makula.

The perennial litigant recalls that during this session, State Attorney Lamula Ddamba categorically informed court that upon consulting her resident chief state attorney Janat Kitimbo, it had been resolved that the DPP would not to take over the case.

Mabirizi goes on to say that with the magistrate guiding that he should go ahead and prove the case against Bujjingo and Makula, he has since secured evidence such as the video recorded by Salt TV on December 07, and was ready for Bujjingo’s and Makula’s plea taking on January 21.

Reeling from a decision by DPP Jane Frances Abodo to discontinue criminal proceedings against NUP leader Robert Kyagulanyi aka Bobi Wine who Mabirizi wanted tried for obtaining registration to Makerere University by false pretence, the youthful lawyer has now sworn that he “will not allow the DPP to play around with my case and moreover to make court as an unserious place where she breathes cold and warm at the same time.”

He added: “DPP must know that she cannot eat her cake and have it at the same time. If she wanted to take over, she would not have informed the Court that she will not take over.”

Mabirizi went on to claim that the takeover of his case was “a desperate move” by the ‘man of God’ and his ‘wife’ to get off the hook after reportedly trying to “threaten, intimidate and compromise both Court and Private Prosecutor” but failed. “He [Bujjingo] has now seen DPP’s office as a soft spot but it is too late since the same office is on Court record declining to disturb the Prosecutor,” Mabirizi further alleged.
